ORDER

The applicant was discharged on 31.01.2024. He was in a Permanent Low Medical Category on account of disability of ‘PIVD L3-L4/L4-L5’, the extent of which was assessed to be 57% for life but neither attributable to nor aggravated by military service. Thus, claim for grant of disability element was rejected.

Learned counsel for the applicant has relied upon Categorization Medical Board dated 20.07.2023 (Annexure A-2) to submit that the said Board had assessed the disability to have been aggravated by military service. The Release Medical Board could not have assessed it differently without taking into consideration the earlier finding.
