ORDER

The applicant was discharged on completion of tenure on 28.02.2021. He was in a Permanent Low Medical Category on account of disabilities of (a) ‘Primary Hypertension’, the extent of which was assessed to be 30% for life but neither attributable to nor aggravated by military service and (b) ‘Diabetes Mellitus Type-II’, the extent of which was assessed to be 20% for life but neither attributable to nor aggravated by military service. Composite extent was assessed to be 44% for life. Claim for grant of disability element was rejected because both the disabilities were neither attributable to nor aggravated by military service.

Learned counsel for the applicant confines his claim to grant of disability element for the disability of ‘Primary Hypertension’ only. His submission is that the said disability could not have been assessed to be neither attributable to nor aggravated by military service merely because onset thereof was in a peace area. Reliance has been placed upon judgment dated 06.12.2024 passed by the Regional Bench, Chandigarh in OA No.861 of 2022, Ex.MWO Bhupinder Singh Vs Union of India and others.
