(1) Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (2 of 1974), in an appeal by the drawer against conviction under section 138, the Appellate Court may order the appellant to deposit such sum which shall be a minimum of twenty per cent. of the fine or compensation awarded by the trial Court:

Provided that the amount payable under this sub-section shall be in addition to any interim compensation paid by the appellant under section 143A.

(2) The amount referred to in sub-section

(1) shall be deposited within sixty days from the date of the order, or within such further period not exceeding thirty days as may be directed by the Court on sufficient cause being shown by the appellant.

(emphasis supplied)

6. From a perusal of the aforesaid provision, it is evident that the maximum period, which can be granted by the First Appellate Court for depositing the entire compensation amount is 90 days. Admittedly, in the case at hand, 90 days have been lapsed. The First Appellate Court has no power to extend the time beyond 90 days.

7. For the bona fide reasons shown in the present petition, time for depositing 20% of the compensation amount as ordered by the trial Court vide order dated 31.07.2024, as extended vide order dated 03.09.2024, is further extended by a period of two weeks from today i.e. 19.12.2024.

In view thereof, present petition is disposed of, so also the pending application(s), if any.
