We have heard Learned Counsel for the Appellant for quite some time, as well as Learned Counsel appearing for Respondent No. 1 i.e. Tata Capital Housing Finance Limited & Ors., and Learned Counsel for the IRP, and perused the record.

During the course of the deliberation, it is surfaced that, on 31.08.2026, while disposing of I.A. No. 6053 of 2026 a coordinate Bench of this Appellate Tribunal comprising on three Hon’ble Members in Comp. App. (AT) (Ins) No. 06 of 2026 has provided a mechanism with regard to the disposal of the section 12(A) application which was ultimately moved by the RP and by passing the impugned order has unfortunately been rejected.
Without commenting on the merits of the case and having regard to the Judicial propriety, we direct that the instant appeal be immediately placed before the Bench which has passed the order dated 31.08.2026 in Comp. App. (AT) (Ins) No. 06 of 2026, on 30.10.2026.
Accordingly, list this appeal on 30.10.2026, before Bench No. 1, under the same caption.
