1. 1. The appellant filed S.A. bearing no.471/2024 titled as **Prem Pal Bhardwaj V Central Bank of India** which was stated to be pending before DRT-I, Delhi. The S.A. bearing no.471/2024 was listed on 13.10.2025 and on that day S.A. was ordered to be dismissed in default for non-prosecution due to the non-appearance of the appellant before DRT-I, Delhi. Thereafter, the appellant filed Misc. Application bearing no.176/2026 for restoration of S.A. bearing no.471/2024 which was ordered to be dismissed vide order dated 05.10.2026 on ground of limitation.
2. 2. DRT-I, Delhi observed that Misc. Application bearing no.176/2026 was filed after a delay of more than eleven months. The relevant portion of the impugned order dated 05.10.2026 is reproduced as under:
3. 4. Admittedly, there is delay of more eleven months in filling the present misc. application in the aforesaid securitization application because the present misc. application is filed on 10.09.2026 in the aforesaid SA no.471/2024, whereas the said securitization application was dismissed in default on 10.09.2025. Thus, the present misc. application is barred by limitation and even otherwise the applicant has failed to give any plausible delay for filling the present misc. application. Accordingly, the application for condoning the delay in filling the present misc. application in the said SA stands dismissed and consequently, the present misc. application also stands dismissed being barred by limitation.
1. 3. Sh. Manan Agarwal, Advocate for the appellant stated that the auction of the subject property is scheduled for today and as such the respondent be restrained from proceeding with the auction of the subject property.
2. 4. Sh. Subodh Kumar Singh, Advocate for the respondent stated that similar relief has already been declined on three occasions by DRT-I, Delhi and S.A. bearing no.471/2024 was not filed to challenge the auction proceedings before DRT-I, Delhi. He further stated that the present appeal is liable to be dismissed and further the appellant is not entitled for interim relief as prayed during the course of argument.
3. 5. The impugned order is appearing to be procedural in nature without being a substantive order.
4. 6. After considering all facts, the delay in filing the Misc. Application bearing no.176/2026 is condoned and the S.A. bearing no.471/2024 is ordered to be restored to its original number. Now as S.A. is ordered to be restored to its original number, the appellant shall be at liberty to file appropriate application for passing any interim relief in accordance with law.
5. 7. The appellant is directed to appear on 04.11.2026 before DRT-I, Delhi for further directions.
