TOURISM FINANCE CORPORATION OF INDIA LTD vs ASLAD HOTELS AND LEASING CO PVT and ors on 22 October 2026

1. The present Misc. Application bearing no. 38/2020 is filed with the following prayer.

ix. Transfer the recovery proceedings, i.e., TRC No. 24/2002 titled as Indian Overseas Bank vs M/s Tirupati Balaji Motors (M & M Division) pending before Ld. RO, DRT-III, Delhi to Ld. Recovery Officer, DRT-I, Delhi where RC No. 66/2005 titled as TFCI V M/s Asiad Hotels & Leasing Company Pvt. Ltd. & Ors is pending before the Ld. Recovery Officer-I, DRT-I, Delhi and RC No. 39/1999 titled as ARCIL Vs Super Estates Pvt. Ltd. & Ors is pending before Ld. RO-II, Delhi and club all three recovery proceedings so that the mortgage property be put to sale to expedite recovery of the legitimate dues.

2. Ms. Usha Singh, Counsel for the appellant advance the argument on the basis of prayer and stated that the RC bearing Nos. 24/2002, 66/2005 and 39/1999 may be clubbed together before any one of the Recovery Officer for appropriate adjudication. She further stated that the subject property is same and the contesting parties are also same in all the three recovery certificates.

3. After considering all the facts, all three recovery certificates as mentioned herein above are transferred to Recovery Officer-II, DRT-I, Delhi. The application is accordingly decided. The copy of this order be sent to concerned DRT.
