MR C M SUBRAMANIAN vs ASSET RECONSTRUCTION COMPANY INDIA LIMITED on 28 October 2026

IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI

R.A(S.A):34/2025

C.M.Subramanian Vs Arcil

28/10/2026

Learned counsel for the appellant submitted that SA 42/2020 has been filed to set aside the order passed under Section 14 of the SARFAESI Act. SA 42/2020 was dismissed on the ground that it was barred by limited and on merits also. It is the submission of the learned counsel for the appellant that SA 42/2020 has been filed within the time of limitation from the date of issuance of notice by the Advocate Commissioner and therefore, there is no question of barred by limitation in filing the SA 42/2020. The property subject to this appeal is not mortgaged with the respondent and therefore, the proceedings under the SARFAESI ACT, especially, under Section 14 of the SARFAESI Act is not legal. Since the learned counsel for the respondent is not ready, post the matter on 09.12.2026 for continuation. Sd/-
