Debts Recovery Tribunals and Appellate Tribunals

A SASI KUMAR vs MANAPURAM HOME FINANCE LTD AND ORS on 29 October 2026

IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI

IA 814/2026 (Delay) in A.IR:293/2026

A Sasi Kumar V/S Manapuram Home finance ltd & 3 ors 29/10/2026

Learned Counsel for both sides are present. R3 is already given up.

This application is filed for condoning the delay of 22 days in filing this appeal.

It is the submission of the Learned Counsel for Petitioner that technically, there is no delay in filing this appeal for the reason that the order of the Learned Presiding Officer, DRT, Madurai was uploaded on 25.12.2025, the copy application was filed on 30.12.2025, the same was received on 28.1.2026, and this appeal was filed on 30.1.2026. The delay, if any, is due to administrative reasons in obtaining the certified copy.

Learned Counsel for R1, R2, and R4 strongly opposes the reasons stated for the delay.

Considered the rival submissions and perused the records.

Admittedly, the impugned order in IA 1643 of 2024 in SA SR No. 4509 of 2024 was passed on 9.12.2025. The copy application was not filed immediately but was filed only on 30.12.2025. The limitation starts from the date of the order. Therefore, admittedly, there is a delay in filing the copy application and that was the reason for the delay of 22 days in filing this appeal.

Be that as it may. With a view to give an opportunity to the Petitioner to prosecute this appeal, the delay of 22 days is condoned, subject to payment of costs of Rs.2,000/- to the Library of DRT/DRAT Bar Association, Chennai, on or before 12.11.2026.

Post the matter for compliance on 16.11.2026.
