8. noticed a number of persons gathered there. He had also gone there and noticed Pradhan Kiran Sharma (applicant); Up-Pradhan Sandeep Mehta; Panchayat Secretary Rajiv Kumar; Ward Member Trai Virender Thakur; and local residents, namely Sadanand, Rakesh Thakur amongst others.

14. As per the directions of this Court, the applicant has joined the investigation. In the status report filed today, there is nothing on the record to show that the custodial interrogation of the applicant is required, in this case.

15. Even otherwise, the role, allegedly played by the applicant, in the commission of the alleged offence, will be proved during the trial and, as such, no useful purpose would be served by dismissing the application, which would be nothing, but, would amount to remanding the applicant into judicial custody.

application, cannot be rejected, as a matter of punishment, as pre-trial punishment is prohibited under the law.

18. Considering all these facts, this Court is of the view that interim protection granted to the applicant, vide order, dated 26th December, 2023, is liable to be confirmed.

19. Consequently, interim order, dated 26th December, 2023, is made absolute. Therefore, it is ordered that the applicant be released on bail, in case FIR No. 250 of 2023, dated 21st December, 2023, registered under Section 3 (1) (s) of the SC&ST Act’), with Police Station Dhalli, District Shimla, H.P., on her furnishing personal bonds, to the tune of 30,000/-, ₹ with one surety of the like amount, to the satisfaction of

20. Any of the observations, made hereinabove, shall not be taken as an expression of opinion, on the merits of the case, as, these observations, are confined, only, to the disposal of the present bail application.
