1. This hearing has been done through hybrid mode.

2. The present petition has been filed by the Petitioner under Article 226 of the Constitution of India, inter alia, seeking inclusion of the Petitioner’s name in the survey for the site 134-M, T/B Site, L-Block, Connaught Place, New Delhi (hereinafter, ‘subject site’).

3. The brief background is that, initially, on 22nd June, 1999, the subject site, admeasuring 4 x 3 feet, was allotted to one Mr. Shambhu Singh for setting up a pan thara for the sale of pan, bidis and cigarettes. Mr. Shambhu Singh is stated to be the father-in-law of the Petitioner.

4. The fact that Shambu Singh was a recognized tehbazari holder is also noted in the VC Chaturvedi Committee Order No. 103-A dated 22nd June, 1999.

5. Mr. Shambhu Singh passed away on 27th November, 2011, leaving behind two sons, namely, Mr. Rajinder Singh and Mr. Vijay Singh, both of whom had moved a transfer application before the NDMC, sometime in 2018, seeking transfer of the subject site in their names.

6. Thereafter, Mr. Rajinder Singh also passed away on 6th June, 2024. The Petitioner herein is the wife of Mr. Rajinder Singh and claims rights in respect of the subject site through him.

7. According to the Petitioner, the other son of Mr. Shambhu Singh, i.e., Mr. Vijay Singh, resides in their native village. Accordingly, the Petitioner seeks that the subject site be included in the list for the survey currently being carried out by the NDMC.

8. Ld. Counsel for the NDMC submits that, the Petitioner being the daughter-in-law of Mr. Shambhu Singh, her name could be substituted in place of her husband, Mr. Rajinder Singh.

9. Heard. The Court has perused the death certificate of Mr. Rajinder Singh which has been placed on record. The VC Chaturvedi Committee Order No. 103-A dated 22nd June, 1999, mentioning the name of late Mr. Shambhu Singh, has also been perused.

10. It is noted that the transfer application dated 10th October, 2018 bears the names of Mr. Rajinder Singh and Mr. Vijay Singh.

11. Under these circumstances, as there appears to be no doubt regarding the identity and veracity of the Petitioner’s case, the subject site shall be included in the survey list of the NDMC, with the names of the Petitioner and

her brother-in-law i.e., Mr. Vijay Singh, reflected therein. Ordered accordingly.

12. After completion of the survey by the NDMC, a Certificate of vending shall be granted in the joint name of the Petitioner and Mr. Vijay Singh, subject to the decision of the TVC-II.

13. In the meantime, the Petitioner shall not be disturbed from vending from the subject site.

14. The petition is disposed of in these terms. Pending applications, if any, are also disposed of. PRATHIBA M. SINGH JUDGE DINESH BHATT JUDGE OCTOBER 29, 2026 dj/sm
