(Oral) On 23.12.2022, the Court passed the following order:- “Learned counsel for the petitioner states that the private respondent who has joined in place of the petitioner at GHS Gahghori is going to retire on 1Whether the reporters of the local papers may be allowed to see the Judgment?Yes
31.12.2022 and the petitioner can conveniently be posted back at GHS Gahghori. The prayer appears to be reasonable, as the petitioner admittedly, is a Class-IV employee, serving as a Peon, has been ordered to be transferred to a distance of 150 kilometers. In this view of the matter, let positive instructions be imparted by the official respondents on the next date of hearing. List on 28th December, 2022.”

Today, the official-respondents have placed on record the instructions, the relevant portion whereof reads as under:- “In compliance with CWP No. 6184/2022, it is submitted that Shri Sohan Lal, Peon, who is presently working at GMS Samtehan, u/c GSSS Tarsooh, Distt. Bilaspur can be adjusted at GHS Gah- Ghori, Distt. Bilaspur after superannuation of Smt. Kamla Devi, Peon on dated 31-12-2022. May kindly be informed to the Hon’ble High Court accordingly please.”
3. Now that the official-respondents are ready to adjust the petitioner at GHS Gah-Ghori, District Bilaspur, after superannuation of the present incumbent,who is due to retire on 31.12.2022, nothing survives for adjudication.
4. Accordingly, the instant petition is disposed of with a direction to the official-respondents to abide by their undertaking.
