CENTRAL ADMINISTRATIVE TRIBUNAL MUMBAI Order Sheet Item no.: 3 Diary No: 127/2026 [ APPOINTMENT ] Court No.: 2 No of Adjournment: Order Dated: 26/10/2026 PRASHANT KAUSHIK Vs PERSONNEL PUBLIC GRIEVANCES

For Applicant(s) Advocate : Shri Prashant Trivedi h/f Khushboo Jain For Respondent(s) Advocate : Order of The Tribunal The applicant has filed the present OA which is placed by the Registry on the point of maintainability. Learned counsel for the applicant submits that earlier OA No.268/2023 has been filed by the applicant in which order dated 19.04.2023 was passed and the OA was dismissed at admission stage itself. The aforesaid order was subject matter of challenge before the Hon'ble High Court of Bombay in Writ Petition No.3450/2024 and the Hon'ble High Court vide its order dated 16.06.2025 passed the following order: "6. In our opinion, the Tribunal should have decided the original application based upon the contentions raised by the Petitioner (original applicant) in its challenge to the order impugned before the Tribunal. The order passed by the Tribunal calls for interference as it does not deal with any of the contentions raised by the Petitioner in the original application. Consequently, the impugned order is set aside. The original application is remitted to the Tribunal for a fresh hearing and in accordance with law. We may not be understood to have expressed any opinion on the merits of any of the contentions.

7. The Writ Petition is disposed of."

2. It is submitted by the learned counsel for the applicant that although the present OA has been filed, however, the whole OA is same as that of OA No.268/2023.

3. Taking into aforsaid aspect, Registry is directed to register the OA and thereafter issue notice to the respondents returnable within four weeks.

4. List the matter on 15th December, 2026.
