By way of present contempt petition filed under Ss. 11 and 12 of the Contempt of Courts Act, 1971, prayer has been made on behalf of the petitioner for initiation of contempt proceedings against the respondent for having willfully and intentionally disobeyed the order dated 1.4.2019, passed by a Division Bench of this Court, whereby Court during the pendency of the petition, directed the respondent to pay revised higher pension to the petitioner, subject to the condition that in case the petition fails, respondent shall be entitled to recover the arrears from the future pension.

2. Precisely, the grouse of the petitioner is that after passing of aforesaid order dated 1.4.2019, arrears on account of revised higher pension have not been paid to the petitioner. Learned counsel for the respondent Mr. Raman Sethi, Advocate states that since there is no direction, as such, to pay arrears on account of revised higher pension, there is/was no occasion to release the aforesaid amount. He states that the revised higher pension to the petitioner after passing of order dated 1.4.2019, is being paid regularly and amount of Rs.56,992/- was inadvertently transferred to the account of the petitioner, on account of system error, which stands withdrawn.

3. Consequently, in view of above, this Court finds that no contempt has been committed by the respondent, as such, present petition is disposed of being without merit. Notice, if any, issued to the respondent is discharged.
