2 3 of the order dated 4th October, 2018 is modified to the extent re: disposal of OA No. 4539 of 2017 pending before Himachal Pradesh Administrative Tribunal (hereinafter referred to as 'the Tribunal'). The direction issued regarding deemed disposal of the abovestated OA is recalled and OA No. 4539 of 2017, titled as Dr. D.D. Gupta versus State of H.P. and Ors., pending before the Tribunal is ordered to be revived. The Review Applicant may pursue the said OA and the Tribunal shall be at liberty to proceed with the OA in accordance with law.
2. The Review Application is allowed in above terms.
3. It is clarified that we have not expressed any views on merits of the issue pending before the Tribunal. (Surya Kant) Chief Justice
