ORDER (ORAL)

Hon’ble Ms. Harvinder Kaur Oberoi, Member (J)

1. The applicant has filed the present Original Application seeking appropriate directions to the respondents in connection with his candidature for the post of Constable (Driver) Male, Delhi Police Examination, 2025, on the ground that his height was incorrectly measured during the Physical Endurance and Measurement Test (PE&MT).

2. Learned counsel for the applicant submits that the Staff Selection Commission (SSC) issued the notification for recruitment to the post of Constable (Driver) Male in Delhi Police Examination, 2025, pursuant to which the applicant participated in the PE&MT. During the said test, his height was recorded as 168.6 cm. Being aggrieved by the aforesaid measurement, the applicant preferred an appeal against the height measurement. Pursuant thereto, his height was re- measured on 05.10.2026 and was recorded as 167.9 cm.

3. Learned counsel for the applicant further submits that, on 14.10.2026, the applicant got his height measured independently at the District Civil Hospital, Charkhi Dadri, Haryana, where his height was recorded as 170 cm. It is contended that the discrepancy between the measurements recorded by the respondents and the subsequent measurement at the Government hospital raises a genuine doubt regarding the correctness of the height measurement conducted during the PE&MT. Despite the applicant having raised a grievance before the competent ARTI

authorities and requested that the error be corrected, no corrective action has allegedly been taken by the respondents.

4. The applicant, therefore, seeks appropriate directions for fresh and independent measurement of his height and for consideration of his candidature for the post of Constable (Driver) Male, Delhi Police Examination, 2025, including permission to participate in the subsequent stages of the selection process, subject to fulfilment of the prescribed eligibility conditions.

5. Per contra, learned counsel for the respondents opposes the relief sought by the applicant and submits that the physical measurement was conducted in accordance with the prescribed recruitment procedure. It is contended that the applicant’s height was measured during the PE&MT and re-measured pursuant to his appeal, and that a subsequent measurement obtained independently cannot, by itself, invalidate the measurement recorded by the competent authorities. The respondents accordingly oppose the request for further consideration of the applicant’s candidature.

6. We have considered the submissions made by learned counsel for the parties and perused the material placed on record.

7. The issue requiring consideration is whether, in view of the discrepancy between the measurements recorded during the PE&MT and the subsequent measurement recorded at the District Civil Hospital, Charkhi Dadri, Haryana, an opportunity for fresh measurement by the prescribed method ought to be granted to the applicant. 8. In this regard, we may refer to the order dated 20.05.2024 passed by this Tribunal in O.A. No. 503/2024, Mukul Choudhary v. Staff Selection Commission & Anr. In the said matter, the applicant had challenged the result of the physical test on the ground that his height had been recorded as less than 170 cm and had sought measurement by an independent Special Medical Board. Learned counsel for the applicant therein relied upon the order passed by a Co-ordinate Bench in O.A. No. 2813/2021, Abhishek Kumar v. Staff Selection Commission & Ors., dated 28.03.2023, and sought similar directions. The respondents in that matter did not dispute the same.

9. The Tribunal in O.A. No. 503/2024 reproduced the following directions issued in Abhishek Kumar (supra): “After hearing both the learned counsel, we find that there is discrepancy between the results of PETs held for Delhi Police Examination-2016 and 2020 while quoting the height of the applicant. The Standing Order No.212/2020 specifically stipulates that the height of the applicant would be measured by digital mode whereas it has been done by manual mode. In the interest of justice, the respondents are directed to get the height of the applicant measured once again by digital mode in a Govt. hospital run by the Delhi Government recommended by the competent authority for the purpose. The said exercise be completed within a period of four weeks from the date of receipt of certified copy of this order.”

10. Thereafter, in O.A. No. 503/2024, the Tribunal observed as follows: “For parity of reasons, we dispose of the present OA in terms of the directions given in the aforesaid OA.” The Tribunal further reproduced the directions issued in Abhishek Kumar (supra) and disposed of the Original Application in the light of those directions, with no order as to costs. 11. Having regard to the aforesaid decision and the facts of the present case, we are of the view that the discrepancy in the measurements relied upon by the applicant warrants an opportunity for fresh measurement by digital mode. Such an exercise would enable the respondents to ascertain the applicant’s height through an objective procedure without expressing any opinion at this stage on his ultimate eligibility or entitlement to appointment.

12. Accordingly, the present Original Application is disposed of with a direction to the respondents to arrange for the applicant’s height to be measured afresh by digital mode at a Government hospital identified by the competent authority. The exercise shall be completed within a period of four weeks from the date of receipt of a certified copy of this order.

13. Upon completion of the aforesaid exercise, the respondents shall consider the result of the fresh measurement and the applicant’s candidature for the post of Constable (Driver) Male, Delhi Police Examination, 2025, in accordance with the applicable recruitment rules and eligibility conditions. It is clarified that the direction for fresh measurement shall not, by itself, confer any automatic right to appointment or further participation in the selection process.

14. There shall be no order as to costs.
