Order

This Criminal Original Petition has been filed to call for the entire records relating to Crime No. 30 of 2026 pending on the file of the All Women Police Station, Valasaravakkam, and quash the same.

2. Pending this petition, the parties have decided to bury their hatchet and compromise the dispute amicably among themselves.

3. An affidavit has been filed by the defacto complainant/second respondent before this Court, wherein she has stated that she and the accused were working together at Sai Arc Pvt., Ltd. Company and developed a relationship from December 2023. On the pretext of marriage, they had consensual sexual intercourse several times at the residence of the accused at Porur. However, the accused subsequently avoided her for three months and gave lame excuses for not marring her, stating that his elder sister was yet to be married. Hence, she lodged a complaint before the respondent police on 20.10.2026, based on which an FIR was registered in Crime No.30 of 2026. Pursuant to the said complaint, the accused was arrested for the offences punishable under Sections 69, 115(2) of BNS and remanded to Judicial custody by the learned Judicial Magistrate No.I, at Poonamallee, Tiruvallur District. Now, the defacto complainant/second respondent has voluntarily entered into a

compromise with the accused and is willing to compound the dispute and settle the matter amicably. She is not inclined to pursue the case any further against the accused. In order to establish their identities, the parties have also produced copies of their Aadhaar cards, which have been made part of the record. This Court, having considered the affidavit filed by the defacto complainant/second respondent and being satisfied that the parties have arrived at an amicable settlement, proceeds to pass the following order.

4. Under such circumstances, no useful purpose will be served in keeping the First Information Report pending, even though, the offences involved are non compoundable in nature. In the light of the guidelines given by the Hon'ble Supreme Court reported in 2017 9 SCC 641 in the case of Parbathbhai Aahir @ Parbathbhai Vs. State of Gujrath, this Court in exercise of its jurisdiction under Section 482 Cr.P.C.,/Section 528 of BNSS, 2023, quashes the FIR in Crime No.30 of 2026 pending investigation on the file of the first respondent.

5. In view of the above, the FIR in Crime No.30 of 2026, pending on the file of the first respondent, is hereby quashed. The affidavit filed by the defacto complainant/second respondent shall form part and parcel of this Order. The petitioner shall pay a sum of Rs.10,000/- (Rupees Ten Thousand only) towards costs to the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, forthwith and file a photocopy of the receipt along with a memo

reporting compliance before the Registry. The Superintendent of Prison, Sub Jail, Poonamallee, Tiruvallur District, is directed to release the petitioner forthwith, if his detention is not required in connection with any other case.

6. Accordingly, the Criminal Original Petition stands allowed. 30-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No AH NOTE: ISSUE ORDER COPY ON 30.10.2026 To
