ORDER
(Order of the Court was made by G.Arul Murugan, J.) This contempt petition has been filed alleging disobedience of the order of this Court by the respondents.
2. This Court had disposed of WP No.43954 of 2025, vide order dated 10.12.2025, directing the respondent authorities to conclude the proceedings initiated against respondent No.5 therein/temple, within an outer time limit of three months. However, this Court made it clear that the order and the proceedings shall not be treated as a stamp of approval on the action which is being sought to be taken by the authorities against the temple, and it would be open to the temple to seek such remedy if it is aggrieved by the notice and eviction proceedings drawn by the official respondents.
3. Mr.Katta Ravi Teja, IAS, Commissioner, Coimbtaore Corporation, is present before this Court.
4. Learned Additional Advocate General, by filing a status report on behalf of the first respondent Commissioner, submitted that in compliance with the order passed by this Court, the Corporation has passed final orders dated 22.10.2026, directing the temple to remove the encroachment within a period of 15 days. Learned AAG further submits that even though the final orders have been passed on 22.10.2026, the temple has filed a suit before the Principal District Court, Coimbatore in O.S.No.1224 of 2026, wherein they have sought declaration and injunction. It is also stated that the petitioner herein and the Corporation have been arrayed as party defendants in the suit. It is further brought to the notice of this Court that the civil court, by order dated 26.10.2026, had granted interim order of status quo in favour of the temple.
5. In view of the fact that already the Corporation has taken action pursuant to the orders passed by this Court and by final order dated 22.10.2026, they have directed the temple to remove encroachment, and since the temple authorities filed the suit and already the civil court has passed an interim order dated 26.10.2026, now, the authorities have to wait for the decision to be taken by the civil court.
6. Finding that there is no willful disobedience and without expressing any opinion on the pending suit, by allowing the authorities to abide by the directions or orders to be passed by the civil Court in the pending civil suit, this contempt petition is closed.
