ORDER

This Civil Revision Petition has been filed under Article 227 of the Constitution of India against the fair and decretal order dated 16.4.2025 passed in I.A.No.9 of 2025 in O.S.No.77 of 2014 on the file of the Principal District Munsif Court at Thiruvallur wherein the application filed by the petitioner/2nd defendant for filing additional documents came to be dismissed.

2. This Court heard the learned counsel appearing on either side, perused the materials available on record and carefully went through the impugned order passed by the Court below.

3. The first respondent is the plaintiff who filed the suit in O.S.No.77 of 2014 seeking for the relief of declaration, permanent injunction and other consequential reliefs. The petitioner who is the second defendant in the suit filed the written statement in the year 2023. Later, I.A.No.9 of 2025 was filed by the petitioner/2nd defendant for filing ten additional documents.

4. The Court below dismissed the said application mainly on the ground that all the documents relied upon had come into existence only after the suit was filed and that there were absolutely no averments made in the written statement touching upon those documents. The Court below also took into consideration the fact that earlier applications were filed for filing additional documents, which were allowed and once again the present application has been filed by the petitioner/D2 to file the additional documents.

5. In the considered view of this Court, the impugned order passed

by the Court below does not suffer from any perversity warranting the interference of this Court. As rightly found by the Court below, the documents, which had come into existence after the filing of the suit, were sought to be relied upon. That apart, there were no averments in the written statement relatable to those documents that were sought to be brought in as additional documents. The present attempt has been made by the petitioner/D2 only to drag on the proceedings and there are absolutely no merits in the said application filed by the petitioner.

6. In the result, the civil revision petition is dismissed and the impugned order dated 16.4.2025 passed in I.A.No.9 of 2025 in O.S.No.77 of 2014 on the file of the Principal District Munsif Court at Thiruvallur is sustained. There shall be a direction to the Principal District Munsif Court at Thiruvallur to dispose of the suit in O.S.No.77 of 2014 within a period of three (3) months from the date of receipt of a copy of this order. No costs. Consequently, the connected CMP is also dismissed. 29-10-2026
