ORDER
The Civil Revision Petition is filed challenging the docket order passed by the Executing Court E.A.No.1 of 2026 in E.P.No.1526 of 2026 in O.S.No.6428 of 2023, dated 19.09.2026 allowing the petition filed by the

respondent seeking police protection for execution of warrant issued by the Executing Court.
2. It is not in dispute that the respondent herein filed a suit seeking recovery of damages for defamatory statement made by the petitioners. The said suit was decreed by directing the 1st petitioner to pay a sum of Rs.2,50,000/- as damages to the respondent/plaintiff, within a period of two month from the date of decree. Since the said decree has not been complied with, the respondent filed execution petition in E.P.No.1526 of 2026. The said execution petition was allowed on 21.07.2026 by ordering attachment sale of movable properties of the 1st petitioner. The said order of attachment passed by the Executing Court has not been challenged. Since there was resistance by the Judgment Debtors, an application has been filed by the respondent seeking police aid. The said application was allowed by the Executing Court by the impugned based on the report submitted by the Court Amin and the averment found in the application filed by the respondent. Aggrieved by the same, the petitioners have come before this Court.
3. It is seen from the records that till date, the petitioners have not obtained any stay of the decree passed against them. Therefore, there is no

impediment for the Executing Court to proceed with the execution petition. In the execution petition, an order of attachment of movable properties was passed against the 1st petitioner on 21.07.2026 and the said order has not been challenged by the petitioners in the manner known to law.
4. The petitioners only challenged the consequential order passed by the Executing Court ordering police protection to execute the warrant issued by it. Without challenging the order allowing the execution petition, the petitioner is not entitled to challenge the consequential order granting police aid. Therefore, I do not find anything to interfere with the impugned order.
5. Accordingly, the Civil Revision Petition is dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed. 29-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No dm To The XXVIII Assistant City Civil Court, Chennai.
