ORDER

This Civil Revision Petition has been filed challenging the order passed by the first appellate court, dismissing the application filed by the petitioner seeking to condone the delay of 1132 days in filing the appeal.

2. The respondent herein/plaintiff filed a suit in O.S.No.197 of 2015 on the file of Subordinate Judge, Tambaram and it was decreed in favour of him on 08.04.2022. Aggrieved by the same, the petitioner/defendant preferred an appeal before the first appellate court with a delay of 1132 days and the condone delay petition was dismissed by the first appellate court on 16.06.2026. Aggrieved by the same, the petitioner filed the present civil revision petition.

3. The learned counsel for the petitioner by taking this court to the affidavit filed in support of the condone delay petition would submit that after disposal of the suit, the petitioner was prevented from filing an appeal immediately due to her illness and knee problem and hence, he prayed to set aside the impugned order passed by the first appellate court and to allow the condone delay petition.

4. The vague reason given by the petitioner to explain the lengthy delay of 1132 days in filing the appeal is not acceptable. Though it is stated by the petitioner that she was suffering from knee problem and some kind of illness, no medical documents have been filed by her before the first appellate court. The petitioner not even entered the box and depose in support of the averments made in the affidavit filed in support of the condone delay petition. In such circumstances, the first appellate court rightly came to the conclusion that the petitioner failed to explain the inordinate delay and dismissed the condone delay petition. I do not find any material irregularity or illegality in the impugned order passed by the first appellate court.

5. Accordingly, this civil revision petition is dismissed. There shall be no order as to costs. Connected miscellaneous petition is closed. 29-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No MST To The Principal District Judge, Chengalpattu District.
