CRP No. 6859 of 2026 Udumalpet to dispose of the application in IA.No.15 of 2025 in OS.No.238 of 2016 within the time frame fixed by this Court.

2. Heard the learned counsel for the petitioner and carefully perused the materials available on record.

3. It is seen from records that the Interlocutory application in IA No.15 of 2025 has been filed seeking for appointment of an Advocate Commissioner to divide the properties described in the suit schedule property. In view of the same, it will be more appropriate to direct the Court below to dispose of the said application within the time frame fixed by this Court.

4. The learned counsel for the petitioner submitted that the Advocate Commissioner is yet to be appointed by the Court below only based on the stand taken by the respondent that an appeal has been filed before the High Court. In the absence of any stay granted by the Appellate Court, there is no restriction for the Court below to proceed further with the final decree proceedings.

5. In the light of the above discussion, there shall be a direction to the learned IV Additional District Judge, Udumalpet, to dispose off the application in IA.No.15 of 2025 in OS.No.238 of 2016, within a period of four weeks from the date of receipt of a copy of this order.
