Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorari calling for the entire records relating to the impugned charge memo bearing No.TNIGR/2008/2026/B2 dated 12.09.2026
issued by the 1st respondent against the petitioner under rule 17(b) of the Tamilnadu Civil Services (Discipline and Appeal) Rules, quash the same as being arbitrary, illegal, without proper application of mind, contrary to the admitted and registered documentary record, violative of Articles 14 and 21 of the constitution of India and principles of natural justice and consequently forbear the respondents from proceeding further against the petitioner pursuant thereto.

For Respondent(s):
Mr.R.Nandha Kumar,
Additional Government Pleader
ORDER
This writ petition has been filed seeking a writ of certiorari to quash the charge memo bearing No.TNIGR/2008/2026/B2 dated 12.09.2026, whereby the 1st respondent has initiated disciplinary proceedings against the petitioner under Rule 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules by framing a solitary charge.
2. In response to the same, the petitioner has already submitted a written explanation on 23.09.2026 and thereafter approached this Court by filing the present writ petition seeking to quash the impugned charge memo.
WP No. 43261 of 2026

3. The learned counsel for the petitioner, placing reliance on an order passed by a Co-ordinate Bench of this Court in W.P.Nos.617 of 2012 and 8833 of 2013 dated 06.06.2022, contends that the very charge that is framed against the petitioner is by suppressing various facts and without taking note of the various documents that are registered in respect of the property, which is the subject matter of the present charge and therefore, the impugned charge memo is liable to be quashed.
4. This Court, having perused the said order dated 06.06.2026, is unable to accept the contention of the petitioner for the reason that, in the above said writ petition, the challenge was made against the final order passed in the disciplinary proceedings but not against the charge memo. If at all the petitioner is of the view that the charge has been framed against the petitioner without considering the true facts or on the basis of particulars which are not true, it is always open for the petitioner to bring true facts to the notice of the disciplinary authority and ask for dropping of the charges. But, it is not for this Court to go into correctness or otherwise of the charges that are framed against the petitioner at the threshold. As a matter of fact, the petitioner has already submitted his explanation in response to the impugned charge memo as early as on 23.09.2026, and the same is pending for consideration before the 1st respondent.

5. In view of the same, this Court is of the considered view that this is not a fit case where this Court can interfere with the impugned charge memo at this stage.
6. Accordingly, the writ petition is dismissed. However, the 1st respondent is directed to take into consideration the explanation dated 23.09.2026 submitted by the petitioner and then decide whether to drop the charges or to subject the petitioner to a detailed enquiry. In case if the 1st respondent decides to continue the proceedings against the petitioner, all such proceedings shall be concluded as expeditiously as possible, at any rate, within a period of six months from the date of receipt of a copy of this order. No costs. Connected miscellaneous petitions, if any, shall stand closed. 29-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No dpa
