ORDER

This Writ Petition is filed seeking to issue a Writ of Mandamus, directing the respondents 1 and 2 to allow the petitioner to write the examination of arrear subject International Law in the forth coming November 2026 Law College Examination by considering the petitioner’s representation dated 12.09.2026.

2. The learned counsel for the petitioner submitted that the petitioner joined the Three Year LLB Degree Course during the academic years 2021-22, at the 3rd respondent College and successfully completed the course in the year 2023. However, he has to clear few arrears that are still pending to obtain his degree. He was not permitted to write the supplementary examination by the third respondent due to the automated N+2+1 time limit restriction enforced by the University. The petitioner approached the first respondent in person and was informed that the Rules adopted by the Syndicate and Academic Senate shall be

WP(MD) No. 27803 of 2026 prospective and will be applicable for all the students of the University admitted from the Academic year 2019-2020 onwards uniformly. However, he was not allowed to complete the application for his remaining supplementary subject by respondents 1 and 3. Hence, the petitioner submitted a representation dated 12.09.2026 to the respondents requesting the permission of the Registrar for permitting him to appear in the supplementary examination. The same is not considered, hence this Writ Petition.

3. The learned counsel for the respondents submitted that the petitioner's representation would be considered.

4. It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon him to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, non-consideration of the representation by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking its extraordinary powers under Article 226 of the Constitution of India and direct them to consider the same within a stipulated time.

5. In the light of the above observations, there shall be a direction to the respondents to consider the petitioner's representation dated 12.09.2026, on its own merits and pass appropriate orders in accordance with law, after giving notice to the petitioner, as well as all other persons, who may be interested in the subject matter, within a period of two weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.

6. With the above observations and directions, this Writ Petition stands disposed of. No costs. 29-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No Note : Issue order copy on 29.10.2026 pnn
