ORDER

The petitioner asserts that she, her deceased husband and children reside at a refugee camp at Rayanoor, Karur, Tamil Nadu. Upon the death of her husband, Mr.Chandrabalan, she applied for a Legal Heir Certificate. Said request was rejected on the ground that the deceased person and his legal heirs are Sri Lankan refugees.

2. Mr.S.Iniyan Karthik, learned Government Advocate, accepts notice for the respondent.

3. On perusal of G.O.(Ms) No.110, Revenue and Disaster Management, Revenue Administration Wing, RA-3(2) Section, dated 13.03.2024, I find prima facie that it does not stipulate that a Legal Heir Certificate would be granted only to citizens. In this case, the Death Certificate of the deceased records that he died at the Sri Lankan Rehabilitation Camp, Rayanur, Karur, Tamil Nadu. It also contains the name of the petitioner as the wife of the deceased. Considering the fact that a Legal Heir Certificate is issued after conducting an inquiry to ascertain the legal heirs of the deceased at the place of residence of the deceased, I am of the view that reconsideration is warranted. Towards that end, the impugned order is set aside and the matter is remanded to the Tahsildar for

WP(MD) No. 30785 of 2026 reconsideration. After providing a reasonable opportunity to the petitioner, a fresh order shall be issued within two months from the date of receipt of a copy of this order, after taking note of the above observations.

4. This Writ Petition is disposed of on the above terms. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed. 29-10-2026 Index: No Speaking Neutral Citation: No JEN To The Tahsildar, Karur Taluk Office, Karur, Karur District, Tamil Nadu.
