ORDER

This Writ Petition is filed seeking to issue a Writ of Mandamus directing the Respondents to consider the Petitioners representation dated 16.10.2026 for permit the petitioner to submit his internal examination component.

2. The learned counsel for the petitioner submitted that the petitioner pursued Three Year LLB Degree Course during the academic years 2011-2014, at the 4th respondent College and successfully completed the course in the year 2014. However, he has to clear certain papers and few arrears that are still pending, to obtain his degree. In May 2026, he was not permitted to write the examination due to the automated N+2+1 time limit restriction enforced by the University in its portal. The

WP(MD) No. 31121 of 2026 third respondent issued a notification dated 05-10-2026 announcing that the supplementary examinations are scheduled to be conducted from 02- 11-2026 to 23-11-2026. The said notification prescribed 16-10-2026 as the last date for the submission of examination application forms without penalty, 18-10-2026 with penalty and 21-10-2026 as final date for Tatkal registration.

3. However, when the petitioner attempted to register for the said supplementary examinations through the official website of the respondent University on 09.10.2026, he was not allowed to complete the application for his remaining supplementary subject and the portal displayed an error message as “Invalid Register Number and Password” thereby arbitrarily preventing the petitioner from registering for examinations on the strength of the automated N+2+1 time limit restriction. Hence, the petitioner submitted a representation dated 16.10.2026 to the respondents requesting permission of the Registrar for permitting him to appear in the supplementary examination. The same is not considered, hence this Writ Petition.

4. The learned counsel for the respondents submitted that the petitioner's representation would be considered.

5. It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon him to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, non-consideration of the representation by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking its extraordinary powers under Article 226 of the Constitution of India and direct them to consider the same within a stipulated time.

6. In the light of the above observations, there shall be a direction to the respondents to consider the petitioner's representation dated 16.10.2026, on its own merits and pass appropriate orders in accordance with law, after giving notice to the petitioner, as well as all other persons, who may be interested in the subject matter, within a period of two weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.
