ORDER
(Order of the Court was made by ABDUL QUDDHOSE J.) This Court, on the last hearing date, ie., on 12.10.2026, recorded the submission made by the learned Counsel for the appellant that both the appellant and the respondent are dead. On the last hearing date, learned Counsel for the appellant sought time to get instructions as to whether the legal representatives of the deceased appellant will be still interested in prosecuting this appeal.
2. Today, learned Counsel for the appellant would submit that he is unable to contact the legal representatives of the deceased appellant despite his best efforts. Since till date, no steps have been taken to substitute the legal representatives of the deceased appellant in this appeal and since this Appeal is of the year 2023, this Appeal is dismissed as abated. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed. (A.Q.,J.)
