ORDER

By order dated 28.11.2025, the Tahsildar was directed to conduct an inquiry in relation to the petitioner's request for survey after issuing notice __________

( Uploaded on: 29/10/2026 01:12:51 pm )

CONT P(MD) No. 2611 of 2026 to the owners of the relevant adjacent lands, including the fourth and fifth respondents therein. It was clarified that the survey should not be conducted if a credible title dispute exists, whereas a boundary dispute may be decided in accordance with the Tamil Nadu Survey and Boundaries Act, 1923. Alleging that said order was not complied with, the present Contempt Petition was instituted.

2. An affidavit affirmed on 23.10.2026 was filed by the Tahsildar, Uthamapalayam. At paragraphs 13 to 15 thereof, it is stated that survey and demarcation was carried out in Survey No.1659/3C and a part of Survey No. 1659/3B. It is also stated that a portion of Survey No.1659/3B (Part) was entirely fenced and that coconut trees and cattle-feed grass were growing thereon. Consequently, it is stated that the survey could not be concluded in said portion, including on account of a quarrel between the petitioner and the private respondents. At Paragraph 15, it is recorded that a criminal complaint was lodged in this regard against the fourth and fifth respondents and 25 others.

3. On examining said affidavit, I am satisfied that the earlier order was not wilfully disobeyed. __________
