ORDER

This civil revision petition has been filed against the order passed by the Court below dated 31.07.2023 refusing to entertain the application filed by the petitioners for carrying out the amendment in the suit schedule.

2. Heard both sides.

3. The petitioners are the plaintiffs, who filed the suit in O.S.No.145 of 2022 seeking for the relief of partition and for allotment of the respective shares of the plaintiffs. The parties were able to reach a compromise and in the Mega Lok Adalat, they submitted their compromise memo, based on which an award came to be passed in the Lok Adalat on 26.06.2022.

4. Pursuant to the above, an attempt was made to register the award and at that point of time, the parties realised that instead of mentioning the Natham Survey No.449/1, it has been mistakenly mentioned as Survey No.141/8 as per the revenue records. In view of the same, an application came to be filed before the Court below seeking for the following amendment in the schedule of

CRP No. 1567 of 2024 property:- “1) In the plaint, in the description of property in item No.1 & 2 of ‘B’ schedule property delete the survey No.141/8 and substitute as Natham S.No.449/1 = giHa rh;nt vz;/141-2/

2) In the compromise decree in schedules A and B delete the S.No.141/8 and substitute as Natham S.No.449/1 = giHa rh;nt vz;/141-2/”

5. The Court below refused to entertain this application on the ground that such application is beyond the scope of the award passed by the Lok Adalat. Aggrieved by the same, the present civil revision petition has been filed.

6. In the case at hand, the parties were able to enter into a compromise and when the award was attempted to be registered, they encountered a problem, since the revenue survey number was shown in the schedule of property instead of Natham survey number. In the suit schedule, it has been shown as Survey No.141/8, whereas the Natham Survey number is 449/1, which is equivalent to old S.No.141/2. If this amendment is not allowed to be carried out, the entire compromise entered into between the parties and the award passed in the Lok Adalat will be set at naught.

7. In the interest of justice, this Court is inclined to direct the Court

CRP No. 1567 of 2024 below to allow the proposed amendment, so that the necessary amendment can be made in the Lok Adalat award, which can be subsequently presented for registration.

8. In the result, this civil revision petition is allowed in the above terms. No costs. 28-10-2026 Index:Yes/No Speaking/Non-speaking order Internet:Yes Neutral Citation:Yes/No ss To
