ORDER

This Civil Revision Petition has been filed under Article 227 of the Constitution of India to strike off the plaint in O.S.No.5119 of 2025 pending on the file of the XXIV Assistant City Civil Court, Chennai.

2. Heard the learned counsel for the petitioners and carefully perused the materials available on record and this Court also carefully went through the order passed by the Court below.

3. When the matter was taken up for hearing, the learned counsel for the petitioners/defendants submitted that the suit itself had been filed based on forged and fabricated documents and therefore, it is a clear abuse of process of law. The learned counsel further submitted that IA No.2 of 2026 had been filed before the Court below for rejection of plaint under Order VII Rule 11 of C.P.C.

4. In the light of the judgment of the Apex Court in P.Suresh vs. D.Kalivani and Others reported in 2026 SCC online SC 143, this Court is not inclined to entertain the present Civil Revision Petition, since the petitioners have already filed an application for rejection of plaint. It will be more appropriate to direct the Court below to dispose of the said application within a time frame.

CRP No. 6774 of 2026
