JUDGMENT
(Judgment of the Court was delivered by N.Sathish Kumar J.) Challenging the order of the learned Single Judge granting preliminary decree, the present appeal has been filed.
2. When the appeal came up before this Court, the learned counsel for either side submitted that the entitlement of each of the parties are not disputed, however, the dispute is only with regard to some excess possession held by the appellant. According to the appellant, he is in excess possession of 142 sq.ft., and now, it is submitted that the matter has been settled between the parties amicably and the appellant has agreed to pay Rs.9,000/- per sq.ft., to the respondents. In this regard, Joint Memo of Compromise is placed before this Court and the same is taken on record and shall form part of the decree. The parties are also present before this Court and they are identified by their respective counsel.
