ORDER

This writ petition has been filed challenging the impugned order passed by the 2nd respondent in his proceedings No.Na.Ka.9372/99 Ku.Na, dated 16.03.2001, which was subsequently confirmed by the 1st respondent in C.M.A.No.28/2001, dated 03.12.2008, and consequently seeks to quash the same.

2. The matter is listed under the caption "For Dismissal" today. The main Court bundle/record is not available before this Court. However, the counsel for the writ petitioner has produced a copy of the affidavit filed in support of the writ petition.

3. Perusal of the affidavit reveals that the petitioner has challenged the surcharge proceedings dated 16.03.2001, which was confirmed by the first respondent/Tribunal in C.M.A.No.28/2001. The core challenge in this petition is restricted to the surcharge proceedings imposing a liability of Rs.73,086/- for an alleged financial irregularity.

4. The counsel for the petitioner submitted, on instructions, that the petitioner has already retired from service as on date.

WP.No.11951 of 2009

5. In view of the submission made by the counsel for the petitioner, this writ petition stands dismissed. However, the petitioner is directed to remit the dynamic surcharge amount of Rs.73,086/- to the respondents within a period of four (4) weeks from the date of receipt of a copy of this order. It is made clear that if the writ petitioner fails to deposit the said amount within the stipulated period, the respondents are at liberty to recover the dues by enforcing the surcharge proceedings in accordance with law. No costs. Connected miscellaneous petitions, if any, are closed. 28-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No Sni To
