ORDER

The writ petition is filed seeking a direction to the respondents to issue a NOC to the petitioner’s club for running his club in the new. premises in D.No. 4/12, Madurai - Trichy Main Road, Melur Town, Melur Taluk, Madurai District and consequently forbearing the respondents particularly 3d respondent their men or anyone acting under their authority from in any manner interfering with the lawful day-to-day recreational activities of the petitioner club namely T.S. Recreation Club, Melur, by considering the petitioner’s representation dated 24.09.2026 & 05.10.2026.

2. The grievance of the petitioner is that the representation submitted by the petitioner seeking NOC for running his club is pending without consideration. Hence, the petitioner seeks appropriate directions from this Court.

3. Mr.K.Suyambulinga Bharathi, learned Additional Public Prosecutor, who accepts notice on behalf of the respondents, would submit that the representation submitted by the petitioner would be

WP Crl.(MD) No. 5861 of 2026 considered on its own merits within the time to be stipulated by this Court.

4. It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon him to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, non-consideration of the representation by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking its extraordinary powers under Article 226 of the Constitution of India and direct them to consider the same within a stipulated time.

5. In the light of the above observations and also the submissions made, there shall be a direction to the second respondent to consider the petitioner's representation dated 24.09.2026 and 05.10.2026, on its own merits and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the second respondent to consider the same on its own merits. The petitioner is also

WP Crl.(MD) No. 5861 of 2026 directed to produce all necessary supporting documents for obtaining No Objection Certificate for running club before the respondent police.

6. With the above direction, this writ petition is disposed of. 28-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No Rmk To
