Para 35 of the said order reads as under:- "35. In view of above, the OA is allowed. The charge-sheet dated 22.10.2014 and the final orders dated 31.05.2016 are not sustainable in the eyes of laws and the same are set aside. The applicant will also be entitled for all consequential benefits as per rule. No costs."

2. Notice in the C.P. was ordered on 23.11.2025, returnable on 04.11.2025. Matter was further listed on 04.11.2025, 22.12.2025, 12.01.2026, 08.04.2026, and lastly on 05.10.2026. Then at the request of the learned counsel appearing for the respondents, further time to file compliance affidavit was granted to the respondents. Till date no reply has been filed.

3. Learned counsel appearing for the respondents submits that reply has been filed on 28.10.2026, however admittedly, the same is not on record.

4. On the basis of the reply, stated to have been filed, Mr. Khan, learned counsel for the respondents submits that the order/judgment of the Tribunal, under reference, has been challenged before the Hon'ble High Court by way of Writ Petition being W.P. (C) No. 14123/2025.

5. On the other hand, Mr. Luthra, learned counsel for the applicant submits that the said Writ Petition was listed on various dates, including, on 16.12.2025, 10.07.2026, 20.07.2026 and 17.09.2026. Paras 7 and 8 of order dated 20.07.2026 of the Hon'ble High Court in the aforesaid Writ Petition read as under:- "7. Clearly, as the respondent’s charge sheet stood quashed by the Tribunal and there is no stay of the said order by this Court or any other Court, there was no question of relegating the case of the respondent to the sealed cover. The sealed cover procedure can be adopted only in cases where a disciplinary or criminal proceeding is pending against the officer.

8. We, therefore, direct that the sealed cover to which the case of the respondent was relegated be opened and the recommendations of the DPC acted upon, subject, however, to the outcome of this writ petition."

6. From the aforesaid, we find that the respondents have neither taken the final order/judgment of this Tribunal dated 04.09.2024, under reference, seriously nor the observations of the Hon'ble High Court in various orders, including one, dated 20.07.2026, under reference in the aforesaid Writ Petition seriously. Be that as it may.

7. At the request of Mr. Khan, learned counsel for the respondents, further two weeks' time, as last opportunity, is accorded in order to enable the respondents to file an affidavit indicating full compliance of directions of the Tribunal, which may be subject to outcome of the aforesaid Writ Petition, failing which respondent no. 3/Sh.
