ORDER

This Civil Revision Petition has been filed challenging the order of return passed by the Executing Court, returning the impleading petition filed by the petitioner/third party seeking his impleadment in the Execution Petition filed by the respondents 1 to 3/Decree holders in E.P.No.15 of 2017 in O.S.No.48 of 1997.

2. It is seen from the typed set of papers that one Kuppusamy, father of the respondents 1 to 3 had filed a suit in O.S.No.48 of 1997 seeking declaration of title and injunction against the other respondents and obtained a decree. Pending suit, the petitioner purchased the suit property from one of the defendants. Therefore, any decree passed in the suit is binding on the petitioner, as he is only a pendente lite purchaser. In any event, the petition filed by the petitioner to implead himself as a party to the execution petition was returned by the Executing Court, by order dated 08.07.2026. If the application filed by the petitioner is returned, it is for the petitioner to re-present the same by offering his explanations.

3. Therefore, the petitioner is directed to re-present the returned papers in E.A.Sr No.776 of 2026 in E.P.No.15 of 2017, within a period of two weeks from the date of receipt of copy of this order, before the Executing Court,

CRP No. 6602 of 2026 offering his explanations to the objections raised by the Court. If the Court is satisfied with the explanations offered by the petitioner, the application shall be numbered and it shall be disposed of in accordance with law. On the other hand, if the Court is not satisfied with the explanations offered by the petitioner, the matter shall be called in the open court and the petitioner shall be given an opportunity to put forth his case. After hearing the petitioner, the Executing Court shall pass orders on the application on its own merits.

4. With the above clarifications, this Civil Revision Petition is disposed of. There shall be no order as to costs. The Registry is directed to return the original papers in E.A.SrNo.776 of 2026 in E.P.No.15 of 2017 to the counsel for the petitioner. 27-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No MST To The District Munsif cum Judicial Magistrate, Parengipettai, Cuddalore.
