JUDGMENT

(Judgment of the Court was delivered by G.Arul Murugan, J.) This intra-court appeal assails the order dated 24.06.2026 passed in WP No.34771 of 2024, whereby the Writ Court had rejected the challenge made to the order passed by the Tamil Nadu State Information Commission dated 12.09.2023 and the consequential orders.

2. Learned counsel appearing for the appellant contended that, the information, as sought by the appellant, has not been completely furnished and the learned Single Judge, without taking into consideration the incomplete disclosure, has dismissed the writ petition, which is erroneous and seeks interference of this Court.

3. Learned counsel appearing for the respondents submitted that after the order impugned in the writ petition was passed by the first respondent/State Information Commission, all the details as directed have been furnished and, in such circumstances, the learned Single Judge, taking notice of the said fact, dismissed the writ petition, which needs no interference.

4. We have heard the learned counsel for the parties and perused the materials available on record.

5. The appellant is an agriculturist supplying milk to the Government Milk Cooperative Society at Mangoon. The appellant had a grievance in respect of the rates fixed for supply of milk and in this regard, the appellant had submitted an application under the Right to Information Act raising 7 queries. Since the appellant was aggrieved with the information provided, he filed an appeal before the second respondent, the First Appellate Authority as against the information furnished by the Public Information Officer/3rd respondent. The second respondent/First Appellate Authority passed an order and not satisfied with the same, the appellant filed further appeal before the first respondent/Tamil Nadu State Information Commission.

6. The first respondent has summoned the authorities and in the proceedings, it is noted that on 01.10.2021, the details as sought by the appellant in Sl.Nos.1 and 6 have been provided with due acknowledgement on 06.10.2021 and also the other officer of the Cooperative Society appeared before the Commission and produced records showing that the queries in Sl.Nos.2, 3, 4, 5 and 7 have also been furnished to the appellant on 11.10.2021 with proper acknowledgement. The Commission, by its order dated 12.01.2023, held that in respect of Sl.Nos.1, 2, 3 and 6, the details furnished were adequate, but, directed the authorities to provide information regarding query Nos.4, 5 and 7.

7. In compliance with the orders passed by the Information Commission, the Cooperative Sub-Registrar/Public Information Officer, the third respondent, by proceedings dated 25.09.2023, has furnished the details as sought in Sl.Nos.4, 5 and 7, as directed by the Second Appellate Authority.

8. A perusal of the order reveals that the details sought by the appellant seeking details of General Body Meetings were enclosed and the details of salary and allowances of staff of the office of the Deputy Registrar as sought in Sl.No.7 were also enclosed. As regards Sl.No.5, it was intimated to the appellant that inspection of the Society was periodically being done and if any defects are found, the officers would submit a report and since no defects were found, no report has been received and, therefore, no information in this regard is available.

9. The learned Single Judge, in the writ petition filed by the appellant, taking note of the fact that the information as directed by the Tamil Nadu Public Information Commission has already been supplied by the third respondent and observing that merely because the appellant was not satisfied with the information furnished, the writ petition would not lie, dismissed the writ petition.

10. From a perusal of the records, we find that all the queries as raised by the appellant in Sl.Nos.1 to 7 have been duly answered and details have been furnished by the Second Appellate Authority, where a finding has also been recorded that four queries have been answered and a direction was issued to give details regarding three queries, which was also complied with on 25.09.2023. We find that the learned Single Judge has rightly recorded the same and dismissed the writ petition and we find no error or infirmity in the said order. The Writ Appeal is, accordingly, dismissed. There shall be no order as to costs. (SUSHRUT ARVIND DHARMADHIKARI, CJ.) (G.ARUL MURUGAN, J.) 27.10.2026 Index : Yes/No Neutral Citation : Yes/No sra
