ORDER
This Writ Petition has been filed for the following reliefs:- "Directing the respondent to dispose of the petitioner representation dated 17.09.2026 for to issue a birth certificate for the petitioner son was born on 06.10.2018 by removing Yesu Ayya Prabu and recording his name as Samuel within a time frame as may be fixed by this honourable court.” 2.. The petitioner would submit that he married Viji Kala in the presence of elders and that they have been living together as a family. Out of the said wedlock, a male child was born on 06.10.2018 at S.M.V.M.C. Hospital, Kattukuppam, Puducherry.
3. The petitioner would submit that, as he was away in Bengaluru for work-related reasons at the time of his son's birth, his relatives, who were present at the hospital, furnished the child's name as “Yesu Ayya Prabu” for registration of the birth. Accordingly, the said name was entered in the birth register, and a birth certificate was issued.
4. The petitioner would further submit that, upon returning from Bengaluru, he approached the concerned officials and requested them to change his son's name from “Yesu Ayya Prabu” to “Samuel” and issue a fresh birth certificate. However, the officials informed him that the name could not be changed without an order from the competent court. The petitioner would

further submit that, when he approached the officials of the Tamil Nadu Gazette regarding his request to change his son’s name through a Gazette notification, they declined to process the request on the ground that his son was born in Puducherry. Thereafter, when the petitioner approached the officials of the Mannadipet Commune Panchayat, they also insisted upon a court order to effect the name change.
5. The petitioner would submit that, in view of the difficulties faced by his family and in the interest of his son's future, he submitted a representation dated 17.09.2026 to the respondents, requesting them to delete the name “Yesu Ayya Prabu” from the birth certificate and substitute the same with “Samuel”. However, the respondents have not taken any action on the said representation to date. Hence, the petitioner has approached this Court seeking the reliefs stated supra.
6. Heard the learned counsel on either side.
7. Considering the facts and circumstances of the case and the relief sought for by the petitioner, this Court, without going into the merits of the case, directs the respondent to consider and pass appropriate orders on the petitioner's representation 17.09.2026 on merits and in accordance with law, within a period of 4 weeks from the date of receipt of a copy of this order.
