ORDER

This Writ Petition has been filed seeking direction to the 3rd Respondent to complete the Survey and demarcate the boundaries of the petitioners land in old Survey No.441/2A1 in TS No.6 in Block No.58, H Ward of Mugappair Village, Ambattur Taluk, Chennai District and also survey the old survey Nos.441 and 442 situated in Mugappair Village, Ambattur Taluk, Chennai District, as per the order dated 02.12.2016 of this Honble court in W.P. No.16587 of 2016 within the time frame.

2. The learned counsel appearing for the petitioner submits that, despite the order dated 02.12.2016 passed by this Court in W.P. No.16587 of 2016, directing the third respondent to survey and demarcate the boundaries of the petitioner's land after issuing notice to all the parties concerned and affording them a reasonable opportunity of hearing, the survey and demarcation have not been completed. The petitioner claims title to the property comprised in Old Survey No.441/2A1, corresponding to T.S. No.6, Block No.58, H Ward, Mugappair Village, Ambattur Taluk, Chennai District. It is stated that, pursuant to the earlier order of this Court, the third respondent initiated steps for conducting the survey. However, despite subsequent representations made by the petitioner, the survey and demarcation have not been completed.

3. The petitioner has further stated that representations were submitted on 13.03.2025 and 17.05.2025, requesting the third respondent to comply with the earlier directions of this Court. Though the third respondent, by proceedings dated 25.04.2025, directed the surveyors attached to the office to survey and demarcate the property, no further effective steps have been taken.

4. It is also the grievance of the petitioner that, in the meantime, construction activities have been undertaken by the first and second respondents in the disputed area, thereby affecting the petitioner's rights over the property. The petitioner has therefore approached this Court seeking a direction to the third respondent to complete the survey and demarcation in accordance with the earlier order.

5. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents and perused the materials available on record.

6. Considering the facts and circumstances of the case, particularly the earlier order passed by this Court in W.P. No.16587 of 2016, this Court is of the view that the third respondent is required to take effective steps to complete the survey and demarcation of the subject property after issuing notice to all the parties concerned and affording them a reasonable opportunity of hearing.

7. Accordingly, the third respondent is directed to consider the petitioner's representation and complete the survey and demarcation of the property comprised in Old Survey No.441/2A1, corresponding to T.S. No.6, Block No.58, H Ward, Mugappair Village, Ambattur Taluk, Chennai District, in accordance with law and in the light of the order dated 02.12.2016 passed in W.P. No.16587 of 2016, after issuing notice to all the parties concerned and affording them a reasonable opportunity of hearing, within a period of eight weeks from the date of receipt of a copy of this order.

8. It is made clear that this Court does not expressed any opinion on the rival claims of title, if any, over the subject property.

9. Accordingly, this writ petition is disposed of. No costs. K.SURENDER J. 27-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No JAI
