ORDER

The writ petition has been filed seeking a writ of mandamus directing the respondents to disburse the amount of 90 days of private affairs leave Encashment, besides earned leave calculated to the rate of 32 days per year from 01.01.1990 till the date of petitioner’s Husband’s retirement together with interest at 18 percentage for the delayed period from 31.05.2013 till the date of payment at the earliest.

2. It is the case of the petitioner that he was appointed in the respondent Co-operative Society and had retired from service as Casual Labour on 31.08.1983. The petitioner was entitled to leave encashment benefit of 240 days of Earned Leave and the respondents are legally bound to pay the same at the time of his retirement, however it was not paid to him till date. Therefore, the petitioner made several representations to the respondents to pay the benefits along with the interest. Since there is no response, the petitioner is before this Court.

3. Heard the learned counsel on either side and perused the materials available on records.

4. The learned counsel on either side submits that the identical writ petitions have already come up before this Court and were disposed of,

directing the respondents to extend the benefit of leave encashment together with interest at 6% per annum vide W.P.Nos.30813 of 2026 and W.P.No.32309 of 2025, etc., and also further submits that identical order can be passed in the present writ petition as well.

5. In the light of the above, the writ petition is disposed of at the admission stage with the consent of both the parties.

6. Admittedly, the leave encashment benefits has not been paid to the petitioner for no fault of his. Hence, a mandamus is issued directing the respondents to disburse the benefits along with 6% interest for belated payment within a period of twelve (12) weeks from the date of receipt of a copy of this order.
