ORDER

Seeking to direct the 3rd respondent to consider the petitioner's representation dated 29.04.2026 and 10.06.2026, to conduct a proper and independent enquiry into the alleged irregularities relating to the administration of P.S.C. Senior English School, Virudhunagar District and the service, attendance and salary particulars of the Drivers, Conductors and other employees, verify the relevant records and thereafter take appropriate action in accordance with law, this writ petition is filed.

2. The learned Government Advocate (Civil Side) submitted that the representation dated 29.04.2026 as claimed by the petitioner was not at all received by the 1st respondent. However, the representation, dated

WP(MD) No. 25996 of 2026 10.06.2026 was received and the same was forwarded to the 3rd respondent for appropriate action.

3. Heard the learned counsel on either side and carefully perused the materials available on record.

4. It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon the respondent to consider the same on its own merits and pass appropriate orders in one way or other instead of keeping the same pending indefinitely. As such, non-consideration of the representation made by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking the extraordinary powers under Article 226 of the Constitution of India.

5. In view of the limited scope of the relief sought for, the 3rd respondent is directed to consider the representation dated 10.06.2026 made by the petitioner, which has been routed through the 1st respondent by putting the petitioner as well as the 5th respondent on notice and after giving an opportunity of hearing, and take a final decision within a period of four (4) weeks from the date of receipt of copy of this order.

WP(MD) No. 25996 of 2026
