ORDER

Seeking to direct the 2nd respondent to consider the petitioner's representation dated 11.02.2025 and permit the petitioner to redeem the twelve pledged jewellery loans standing in the name of her husband Viswanath, upon payment of the entire outstanding loan amount together with applicable interest and other lawful charges, and upon execution of such indemnity bond or other documents as may be required by the 2nd respondent Bank, and consequently release / deliver the pledged jewellery to the petitioner, this writ petition is filed.

2. The petitioner has sought for a direction to the 2nd respondent Bank, which is a private Bank. The Hon'ble Supreme Court of India in the case of Federal Bank Limited Vs. Sagar Thomas & others reported in 2003 (10) SCC 733 has already made it clear that statutory provisions will not be issued as against any private body and also made it clear that

WP(MD) No. 26942 of 2026 the private Banks are private bodies, against which a writ petition is not maintainable.

3. In view of the same, this Writ Petition stands dismissed, since the remedy is sought for against the private Bank. However, liberty is given to the petitioner to work out the remedy in the manner known to law by filing an appropriate civil suit. No costs. Consequently, connected Miscellaneous Petition is closed. 27-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No gbg To
