ORDER

The present Writ Petition has been filed in the nature of a Writ of Mandamus seeking for a direction to the third respondent to remove the erroneous classification of the property comprised in Survey No.82/12, Amaravathi Village, Karaikudi Taluk, Sivagangai District, measuring approximately 22.6 cents, as “sarkaar Tharisu” in the revenue records and consequently effect mutation in petitioner name and issue patta in petitioner favour.

2. Heard the learned Counsel on either side. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage.

3. Even though the petitioner had approached this Court seeking for a relief of Mandamus for directing the third respondent to remove the erroneous classification of the property comprised in Survey No.82/12, Amaravathi Village, Karaikudi Taluk, Sivagangai District, such __________

WP(MD) No. 30730 of 2026 application for reclassification would have to be made before the Commissioner of Land Administration, Chennai, and the first respondent also do not have the authority to reclassify in spite of the petitioner having been benefited by a judgment and decree of a civil Court as against the State itself.

In that regard, the Writ Petition stands disposed of with the direction to the petitioner to make an application before the appropriate authority as indicated above and on such application being made to the said authority, the same shall be considered in terms of the judgement and decree made in O.S.No.72 of 2008 and as directed by this Court in W.P. (MD)No.2823 of 2021, dated 15.02.2021 and dispose of the same after giving an opportunity hearing to the petitioner as well as to all other interested parties within a period of twelve weeks from the date of receipt of a copy of this order.
