COMMON ORDER

This Court, by an order dated 05.10.2026, had created a window on Red Corner Notice (RCN) for three days to enable the petitioner, against whom the RCN had been issued, to enter this country and appear before the learned Additional Chief Metropolitan Magistrate at Egmore in C.C.No.1387 of 2006. I

posted the matter today, since the relief had been vehemently objected to by Mr. B. Mohan. He had stated that it had become the habit of the petitioner to obtain orders suspending RCN but not presenting himself before the Court.

2. When I took up the matter today, Mr. Radhakrishnan has filed two memos of compliance stating that the petitioner had appeared before the learned Additional Chief Metropolitan Magistrate, Egmore on 21.10.2026 and the non-bailable warrant issued against him had been recalled. The e-court proceedings stating that the petitioner shall execute a bond under Section 88 of the Cr.P.C. has been produced. He further adds that the bond had also been executed.

3. It is the objection of Mr.Mohan that non-bailable warrant had been recalled without notice to the Central Bureau of Investigation. He states that the order had been passed by an in-charge Judge and he ought to have put the respondents on notice.

4. The writ petitions relate only to the RCN that was pending against the writ petitioner. If the prosecuting agency has any grievance against the manner in which the order has been passed by the learned Additional Chief Metropolitan Magistrate, Egmore, it is for the said agency to initiate appropriate proceedings as per law. As the petitioner has appeared before the Court, the

order dated 05.10.2026 has worked itself out. The compliance is recorded and the writ petitions are closed, granting liberty to the respondents to initiate such proceedings as they may be advised.
