ORDER

This Criminal Original Petition has been filed seeking to modify the conditional order dated 24.07.2026 in Crl.M.P.No.1 of 2026 in Crl.A.No.1021 of 2026 by extending the time limit for payment of 20% alone for a period of further 2 weeks.

CRL OP No. 30367 of 2026

2. Heard the learned counsel appearing for the petitioner and perused the materials available on record.

3. The learned I Additional Sessions Judge, V Additional Court (FAC), City Civil Court, Chennai while suspending the petitioner's sentence, imposed certain conditions. One such condition directed the petitioner to deposit 20% of the compensation amount before the learned XXXVIII Metropolitan Magistrate, Fast Track Court-V, Saidapet, Chennai, to the credit of C.C. No. 1383 of 2021, within a period of 60 days from the date of the said order dated 24.07.2026. On 22.09.2026, the petitioner presented the 20% of compensation amount by cash along with an application before the learned Judge. However, on 23.09.2026, the Court returned the cash, stating that the 60-day period from the date of the order 24.07.2026 had expired on 22.09.2026, making the presentation on the 61st day instead of within the stipulated 60 days. Hence, the petitioner has filed the present petition seeking an extension of time and a modification of the order to grant a further period of two weeks to deposit the 20% compensation amount from the date of receipt of a copy of this order.

4. Considering the facts and circumstances of the case and the submissions made by the petitioner’s side , this Court is not inclined to allow the modification petition.

CRL OP No. 30367 of 2026

5. Though this Court is not inclined to modify the conditional order passed by the Appellate Court, this Court is inclined to extend the time to comply with the order passed by the Appellate Court. Accordingly, the petitioner shall comply with the condition imposed in the order dated 24.07.2026 passed by the learned I Additional Sessions Judge, V Additional Court (FAC), City Civil Court, Chennai , in Crl.M.P.No.1 of 2026 in C.A.No.1021 of 2026 in C.C.No.1383 of 2021, on or before 23.11.2026, failing which the present order of this Court extending the time shall automatically stand cancelled and the Appellate Court shall take appropriate action against the accused in accordance with law.

6. In the result, these Criminal Original Petitions stand dismissed. 26-10-2026 Vv To

1. The I Additional Sessions Judge, V Additional Court (FAC), City Civil Court, Chennai.
