ORDER

This Civil Revision Petition has been filed by the revision petitioner seeking a direction to the Principal Subordinate Court, Kumbakonam, to dispose of H.M.O.P. No.346 of 2023 expeditiously.

CRP(MD) No. 2821 of 2026

2. The petitioner is the husband and the respondent is his wife. The petitioner filed H.M.O.P. No.346 of 2023 before the Principal Subordinate Court, Kumbakonam, seeking dissolution of marriage on the grounds of cruelty and desertion. The grievance of the petitioner is that the said petition has not been disposed of expeditiously. Hence, the petitioner has approached this Court seeking a direction to the Principal Subordinate Judge, Kumbakonam, to dispose of H.M.O.P. No.346 of 2023 as expeditiously as possible.

3. The petitioner has also produced the ‘B’ Diary extract. On perusal of the same, it is seen that the petitioner/husband had instituted the petition seeking dissolution of marriage. On 29.08.2025, the petitioner/husband was examined as P.W.1, and Exs.P.1 to P.7 were marked. Thereafter, the matter was posted for cross-examination on 21.11.2025 and again on 23.01.2026. At that stage, it appears that the respondent/wife filed I.A. No.26 of 2026 under Section 24 of the Hindu Marriage Act, 1955, seeking interim maintenance, and the said application is still pending.

4. In view of the pendency of the said application, it appears that the trial Court has not proceeded further with the main petition.

CRP(MD) No. 2821 of 2026 Therefore, the petitioner is at liberty to request the trial Court to dispose of the pending interlocutory application at the earliest and thereafter proceed with the main petition expeditiously. Since I.A.No.26 of 2026 is still pending consideration, this Court is not inclined to issue a direction for the speedy disposal of the main petition at this stage.

5. Accordingly, this Civil Revision Petition is closed for the present, with liberty to the petitioner to renew his request for expeditious disposal if the proceedings in the main petition do not progress for a considerable period after the disposal of the pending interlocutory application. No costs. 26-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No RM Copy to The Principal Subordinate Court, Kumbakonam.
