COMMON JUDGMENT

(Judgment of the Court was delivered by P.Velmurugan J.) Challenging the order of dismissal passed in W.P. (MD) No. 281 of 2017, the present writ appeal has been filed by the appellant/petitioner.

2. With the consent of both parties, this writ appeal is taken up for final disposal at the admission stage itself.

3. Mr. M.P. Senthil, learned Government Pleader, accepts notice on behalf of the first respondent. Mr. A. Kannan, learned Standing Counsel, accepts notice on behalf of the second respondent.

4. The petitioner filed the writ petition seeking a declaration that the entire land acquisition proceedings initiated under the Land Acquisition Act, 1894, in respect of 3 acres and 5,227 sq. ft. of land in Survey No. 544/13, situated in Chettinaickenpatti Village, Dindigul District, had lapsed on account of non-payment of compensation, as contemplated under Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013).

5. The learned Single Judge dismissed the writ petition on the ground that physical possession of the acquired land had already been taken by the respondents. Since physical possession of the land had already been taken by the respondents, one of the essential conditions for invoking Section 24(2) of theRight to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. Therefore, the petitioner is not entitled to seek a declaration that the land acquisition proceedings had lapsed. In these circumstances, we find no merit in the writ appeal.

6. Accordingly, the writ appeal is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.

7. Challenging the order of dismissal passed in Rev.Aplw. (MD).No.45 of 2026, dated 25-03-2026, W.A(MD)No.1682 of 2026 has been filed by the appellant/petitioner.

8. On perusal of the materials on record, this Court finds that the appellant has not demonstrated any error apparent on the face of the record or any other sufficient ground warranting review of the order dated 25.03.2026 passed in Rev.Aplw.(MD) No.45 of 2026. The learned Single Judge, having found no valid grounds for review, rightly dismissed the review application. In the present appeal, the appellant has also failed to establish any illegality, infirmity or perversity in the order under challenge warranting interference by this Court.

9. In the absence of any substantial ground to interfere with the order dismissing the review application, this Court finds no merit in the writ appeal. Accordingly, the writ appeal is dismissed. No costs. Consequently, connected miscellaneous petition is closed. (P.V.,J.) (K.K.R.K.,J.) 26-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No AM To
