ORDER

Mr.S.K.Yuvaraj for Mr.M.Nirmal Kumar, learned Standing Counsel takes notice on behalf of the respondents.

2. The Petitioner has challenged the impugned prohibitory order dated 03.03.2022 passed under the provisions of the ESI Act. However, the Petitioner has not challenged the Assessment Order based on which the impugned prohibitory order has been issued. The assessment order was passed on 24.10.2018. Against the same an appeal ought to have been filed by the petitioner before the Appellate Authority under Section 45AA or before the ESI Court under Section 75 of Act. However, no such appeal was filed in time.

3. It appears that the petitioner had attempted to redress their grievance by filing a Civil Revision Petition in CRP.No.1898 of 2026 which also came to be dismissed on 03.08.2026. However, a copy of the dismissal order, has not been filed along with the typed set of papers. In any event, there is no merits in the Writ Petition, as there is no infirmity in the impugned prohibitory order dated 03.03.2022 of the 2nd Respondent.

4. Accordingly, this Writ Petition is liable to be dismissed and it is accordingly dismissed. No costs. Consequently, connected Writ Miscellaneous Petitions are closed. 26-10-2026 Neutral Citation: Yes/No jas To
