CENTRAL ADMINISTRATIVE TRIBUNAL SRINAGAR Order Sheet Item no.: 5 O.A./1205/2026 (SRINAGAR) [ DISENGAGED ] Court No.: 1 No of Adjournment: 1 Order Dated: 30/10/2026 SAYIKA TARIQ Vs HEALTH AND MEDICAL EDUCATION DEPARTMENT
For Applicant(s) Advocate : MR. BHAT FAYAZ WITH MR. ASIM
For Respondent(s) Advocate : MR. SYED MUSAIB, DAG Order of The Tribunal Heard learned counsel for the parties. Issue notice in O.A./1205/2026. Mr. Syed Musaib, DAG, accepts notice on behalf of all the respondents and seeks time to file the reply, be filed on or before the next date of hearing, with an advance copy to the other side. Learned counsel for the respondents submits that the post from which the applicant has been relieved on 17.10.2026, has been kept vacant and shall be dealt with in accordance with the final order passed in O.A./538/2025. This statement is taken on record. Learned counsel for the applicant, on the other hand, presses for interim relief and submits that the impugned Order No. 753-GMC of 2026 dated 17.10.2026, passed by respondent No. 2, be stayed.
We are of the view that the prayer of the applicant for interim shall be considered after obtaining a detailed response from the respondents. List this matter for filing reply and arguements on interim on 17.11.2026. It is, however, made clear that in case the respondents fail to file their response, the prayer for interim relief shall be considered on the basis of the material available on record, without granting any further opportunity in this regard.
