ORDER

(Order of the Court was made by S.M.Subramaniam, J.) The present writ petition has been instituted seeking a direction to dispose of the appeal dated 15.09.2026 filed by the petitioner under Section 80-A of the Tamil Nadu Town and Country Planning Act, 1971 (hereinafter referred to as “the Act”).

WP.No.43163 of 2026

2. The learned Special Government Pleader appearing for the first respondent, on instructions, made a submission that the petitioner preferred an appeal under Section 80-A of the Act challenging the inspection notice and therefore, the appeal is not maintainable.

3. Section 80-A of the Act enumerates that notwithstanding anything contained in Section 80, the Government may, on application, call for and examine the records of the appropriate planning authority in respect of sealing of the premises under sub-section (2-A) of Section 56 or under sub-section (4) of Section 57 and if, in any case, it appears to the government that any such action or decision should be modified, annulled, reversed or remitted for reconsideration, they may pass orders accordingly. Therefore, an appeal would lie under Section 80-A of the Act only against the orders as specifically stipulated under Sub-section (1) to Section 80-A of the Act. In the present case, appeal has been filed challenging the inspection notice which would not provide a cause of action for preferring an appeal. Thus, the appeal filed by the petitioner is not maintainable under Section 80-A of the Act and in

sequel, the present writ petition filed by the petitioner cannot be entertained.

4. Accordingly, the Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S.,J.) (R.R.V.,J.) 26-10-2026 Index: Yes Speaking order Neutral Citation: Yes/No cse
