ORDER
Heard Mr.K.Nizamuddin for the petitioner and Ms.R.Poornima, Additional Government Pleader for Respondents 1, 2 and 4 and Mr.S.Yogaraja Sekar for respondent 3.
2. The petitioner is the owner of the property situated at 74A/2A, Ooty Main Road, Odandhurai, Mettupalayam, Coimbatore District. She had leased the first floor of the property in favour of an organisation called “Popular Front of India (PFI)”. PFI was proscribed by the Government of India. On account of the said order, the petitioner’s premises was sealed. PFI surrendered the tenancy to the petitioner. On account of the orders passed by the Government of India, the premises continue to be sealed. The petitioner states that from October, 2022, she is unable to use the said premises. Hence, she made a representation seeking de-sealing of the premises on 10.04.2023. As no action has been taken, she is before this Court.

3. When the matter was taken up for hearing on 16.09.2026, I called upon Ms.Poornima to obtain instructions as to whether the petitioner is a mere landlord or is connected with the affairs of the banned organisation. On 13.10.2026, Mr.Arun Anbumani reported that the petitioner is not a part of the banned organisation but wanted time for a detailed report. Hence, the matter was listed today.
4. When I took up the matter today, the Inspector of Police, Mettupalayam Police Station, Coimbatore District has filed a report stating that the petitioner had entered into a tenancy agreement with one Kader Pasha @ Babu for establishment of an office. The enquiry by the police further revealed that there is no connection between the petitioner and PFI. It also shows that there were no suspicious activities in the office leased out to Mr.Kader Pasha.
5. In light of this report, there shall be a direction to the respondents to de-seal the premises and handover the same to the petitioner. Since the petitioner is the owner of the property, the order against alienation that had been imposed on property, the presumption that PFI owned the property is set aside. De-sealing shall be completed within a period of four weeks from the date of receipt of a copy of this order.
