PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order passed by the 2nd respondent vide his proceedings in Na.Ka.No.3446/Aa1/2025 dated 03.07.2025 and the consequential impugned order passed by the 4th respondent vide his proceedings in Na.Ka.No.1446/A1/2025 dated 03.07.2025 and quash the same as illegal and consequently direct the respondents to repost the petitioner in the Government Municipality Schools at Karur Strictly in conformity with the proceedings of the 3rd respondent in Na.Ka.No. 1257/Aa3/2012 dated 28.07.2012 and another proceedings in Na.Ka.No.1772/Aa3/2016 dated 13.08.2016 within the period that may be stipulated by this court.

ORDER
The petitioner, who was working as a Secondary Grade Teacher in the Government Municipal Primary School at Kottaimedu, Karur Union has been transferred to K.Paramathi Union, Karur District on the ground of surplus on 13.08.2026. The petitioner was transferred by order dated 13.08.2016 on certain conditions and condition No.7 reads as follows: “7. ஒன்றியம் விட்டு ஒன்றியம் பணிநிரவல் பெறும் ஆசிரியர்களின் முன்னுரிமையானது முந்தைய ஒன்றியத்திலே (அலகில்) தொ டர்ந்து இருக்கும் அடுத்தடுத்த கல்வி ஆண்டுகளில் முந்தைய ஒன்றியத்தில் ஏற்படும் காலிப்பணியிடங்களுக்கு பணிநிரவலின் போ து செய்யப்பட்ட முன்னுரிமையின்
WP(MD) No. 20230 of 2025 படி வே று ஒன்றியத்திற்கு பணிநிரவல் பெற்றவர் மாறுதலுக்கு உட்படுத்தப்படுவார். மேலும் முந்தைய ஒன்றிய முன்னுரிமையினை துறப்பு செய்ய விரும்பினால் அன்னாரது விருப்பக் கடிதத்து பணிநிரவல் பெற்ற ஒன்றியத்தில் மிகவும் இளையோ ராக முன்னுரிமை நிர்ணயம் செய்யப்படும்.”
2. The petitioner has now filed the writ petition that there is a vacancy in the Government Municipal Primary School at Kottaimedu, Karur Union. However, instead of accommodating the petitioner, who was transferred and posted on surplus on 13.08.2016, some other person has been posted in the said place. Aggrieved over the same, the petitioner has filed this writ petition.
3. The respondents have filed a counter affidavit stating that transfer can be effected within the Union and not from one union to another union. However, the writ petitioner has been transferred on the ground of surplus on 13.08.2016 with an undertaking that as and when vacancy arises in the same school, the person who has been deployed from a particular school would be again transferred. Therefore on this ground this writ petition is allowed. The impugned order is set aside with a direction to the respondents to accommodate the petitioner in the Government Municipal Primary School at Kottaimedu, Karur Union has been transferred to K.Paramathi Union, Karur District. No costs. Consequently connected miscellaneous petitions are closed.
